Human Rights Caucus at Paris Intersessional

Hi all,

This is a very short report of the work done in Paris by the Human 
Rights in the Information Society caucus during the WSIS intersessional 
meeting, July 15-18, 2003.

The caucus was represented by: Diana Bronson from Rights and Democracy 
(CA), Rikke Frank Jorgensen from the Danish Institute for Human Rights 
(DK) and Meryem Marzouki from IRIS (FR).

Apart from the written input that we collectively submitted on May 
31st, the main achievements of the caucus  there were:

- The presentation of an oral statement to the governments plenary, on 
July 16. This statement is entitled "Back to the Basics, WSIS and Human 
Rights".

- The proposal of a rewriting for Paragraph One of the draft 
Declaration of Principles, which was provided to many government 
delegates and to both the president of the intersessional and the WSIS 
preparatory process. It was provided on July 17. We have good hopes 
that this alternative proposal from the HR caucus will become the EU 
official proposal to PrepCom3. It is also supported by the Swiss 
governement, since it has made a very close proposal.

- The presentation of an oral statement to the governements plenary, on 
July 18. This statement has been written and presented by the HR 
caucus, on behalf of the civil society plenary, to express the general 
feeling of the civil society organizations on the last draft of the 
Declaration of principles.

- We also helped the representatives of the CRIS campaign in devising a 
clarification statement, after they have severely been accused in 
plenary session - mainly by medias representatives and journalists 
trade-unions - to threaten freedom of expression and freedom of the 
medias with their proposal of a "right to communicate". Our objectives, 
as HR caucus, has been to help everyone (including the "right to 
communicate" champions) understand that a new right cannot be claimed 
while ignoring that existing rights dealing with information and 
communication (including economic, social and cultural rights) need to 
be reaffirmed and enforced and that only their combination as 
indivisible rights will meet the objectives of the CRIS campaign. The 
resulting statement starts by reaffirming freedom of expression as "the 
basis for individual and societal development", and "communication 
rightS" is now the preferred expression, rather that a "right to

- Last but not least, good contacts with other NGOs, and requests from 
new members to join the HR caucus : Amnesty International, Swiss 
Section (www.amnesty.ch), represented by Yves Steiner, International 
Federation of Journalists (www.ifj.org), represented by Alexander Sami 
from the Swiss Section and Union Network International 
(www.union-network.org), represented by Alke Boessiger, following Neil 
Anderson requests. Their representatives are now on this list, welcome 
to them. The HR caucus is now made up of 25 national or international 
organizations.

Bonjour à tous,

Voici un très bref résumé du travail accompli à Paris par le caucus 
Droits de l'homme dans la société de l'information, durant la réunion 
intersession du SMSI, 15-18 juillet 2003.

Le caucus était représenté par : Diana Bronson de Droits et Démocratie 
(Canada), Rikke Frank Jorgensen de l'Institut danois pour les droits de 
l'homme (Danemark) et Meryem Marzouki d'IRIS (France).

Outre la contribution écrite que nous avons collectivement soumise le 
31 mai, les principales activités du caucus ont été:

le 16 juillet. Ce document est intitulé "Retour aux valeurs 
essentielles : le SMSI et les droits de l'homme".

- La proposition d'une réécriture du Paragraphe 1 du projet de 
Déclaration de principe, fournie à plusieurs représentants d'Etats 
ainsi qu'à la présidente de la réunion intersession et au président du 
processus préparatoire. Ce document a été transmis le 17 juillet. Nous 
avons bon espoir que cette proposition devienne la proposition 
officielle de l'UE. Elle est aussi soutenue par la Suisse, qui avait 
fait une proposition très similaire.

- La présentation orale d'une déclaration à la plénière des 
gouvernements, le 18 juillet. Cette déclaration a été rédigée et 
présentée par le caucus droits de l'homme, au nom de la plénière de la 
société civile, pour exprimer le sentiment général des organisations de 
la société civile à propos du dernier projet de Déclaration de principe.

- Nous avons également apporté notre aide aux représentants de la 
campagne CRIS pour la rédaction d'une motion de clairification, après 
qu'ils ont été sérieusement accusés en session plénière - 
essentiellement par des représentants des médias et des syndicats de 
journalistes - de menacer la liberté d'expression et la liberté des 
médias avec leur proposition d'un "droit à communiquer". Notre 
objectif, en tant que caucus droits de l'homme, a été d'aider chacun (y 
compris les tenants du "droit à communiquer") à comprendre qu'un 
nouveau droit ne peut pas être revendiquer tout en ignorant que les 
droits existants relatifs à l'information et à la communication (y 
compris les droits économiques, sociaux et culturels) nécessitent 
d'être réaffirmés et mis en oeuvre, et que seule leur combinaison, en 
tant que droits indivisibles, permettra d'atteindre les objectifs de al 
campagne CRIS. La motion résultante commence par réaffirmer la liberté 
d'expression comme "la base du développement individuel et sociétal" et 
la notion de "droitS à la communciation" est à présent préférée à celle 
de "droit à communiquer". Le texte de cette motion est disponible sur

- Le dernier mais non le moindre de nos résultats est constitué par 
d'excellents contacts avec d'autres ONGs, qui se traduisent par des 
demandes de nouvelles organisations pour rejoindre le caucus droits de 
l'homme : Amnesty International, Section suisse (www.amnesty.ch), 
représentée par Yves Steiner, Fédération internatiale des journalistes 
(www.ifj.org), représentée par Alexander Sami de la section suisse et 
Union Network International (www.union-network.org), représentée par 
Alke Boessiger, à la demande de Neil Anderson. Les représentants de ces 
organisation sont à présent sur la liste de discussion du caucus, et 
nous leur souhaitons la bienvenue. Le caucus Droits de l'homme dans la 
société de l'information comprend à présent 25 organisations nationales 
ou internationales.
